ICE POLL SHOWS DIVIDED OPINION

Following the worst winter for 30 years and the hazard caused by icy footpaths, there was much news coverage about responsibility for clearing away ice and snow and whether householders run the risk of being sued if they were to undertake such a task.

In response, the Havering Residents' Association undertook an on-line poll to gauge public opinion about whether householders should undertake such responsibilities. However, after 310 votes were cast, the outcome was an equally divided opinion.

Cllr Clarence Barrett, editor of the Havering Residents' Association website (haveringra.org.uk), said: "It is interesting that in Austria, Germany and Switzerland, and some states in America, it is a legal obligation to keep the pavement outside your property clear from ice and snow. However, in the UK it is the Local Authorities who are legally responsible for gritting and salting public roads and pavements.

"In theory, there may be a minor risk of legal action under the part of law known as ‘tort of nuisance' if householders sweep away snow in such a way that it causes injury to someone. However, there would need to be provable malicious intent or a high degree of carelessness".
